1. Acceptance of Terms

By accessing or using fionapattaya.com (the "Site"), operated by Fiona Consultant Group Co., Ltd. ("Fiona Pattaya," "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. About Our Services

Fiona Pattaya provides real estate brokerage services (buying, selling, and investment referrals) and helps connect clients with secured lending, legal, renovation, and visa partners. Fiona Pattaya is a facilitator and referrer for secured lending, mortgage, legal, and renovation services provided by independent third-party partners we are not the lender, law firm, or service provider in those cases unless expressly stated otherwise.

3. Not Investment, Financial, or Legal Advice

Content on the Site including market data, yield calculators, blog posts, and the White Paper is provided for general informational purposes only and does not constitute investment, financial, tax, or legal advice. You should conduct your own due diligence and consult a licensed professional advisor before making any property purchase, investment, or lending decision. Past market performance shown on the Site does not guarantee future results.

4. Property Listings

Property details, pricing, and availability shown on the Site are believed to be accurate at the time of posting but are subject to change without notice and should be independently verified with Fiona directly before you rely on them. Featured listings may be illustrative samples of available inventory rather than a complete or current list.

5. Fees & Commission

Unless otherwise agreed in writing, Fiona Pattaya's standard brokerage arrangement for sellers involves no upfront listing fee, with commission earned only upon a successful sale. Specific fee arrangements for buyers, lending referrals, or other services will be confirmed directly with you before you commit to any transaction.

5a. Commission & Representation

Fiona Pattaya generally works on a success-fee basis for completed sales or business transfers. A typical commission may be 3–5% of the final agreed transaction value, but the exact rate, payer and scope must be agreed in a separate written document with the owner before marketing or introducing a buyer. Web text on this Site is general information only — it is not a contract, not an exclusive agency appointment, and not legal advice.

For rentals, referrals and partner introductions, terms are agreed separately for each case. Submitting property details through the Site does not create an exclusive agency agreement or an automatic commission obligation. Fiona does not guarantee a sale, a price, or a time to sell.

A real commission or representation agreement must be a separate written document. Until that written agreement exists, commission status remains not agreed. These online terms do not replace advice from a licensed Thai attorney.

6. Property Purchases and Promotion Fees

Owner review: describe how the site behaves. This is not a substitute for review by a licensed Thai attorney before payment collection is turned on. Refunds are not automatic and are not promised here.

Fiona Pattaya does not process property purchase payments, rental deposits, or escrow on this website. There is no shopping cart for buying a property and no cryptocurrency payment. Money for a property transaction is handled outside this website, through the parties' own banks, their lawyers, and the Land Department. Fiona does not hold those funds.

A separate optional property promotion fee may be offered for a published sale listing. While promotion collection is closed, the site says property promotion payments are coming soon and does not collect that fee. When Fiona has saved a verified bank account and explicitly enabled collection, an authorised owner can place a promotion order, pay by bank transfer, and upload a payment slip. Uploading a slip does not mean the payment is accepted. Fiona confirms the transfer against the bank record before a promotion starts. A promotion fee does not guarantee buyers, views, or a sale.

If a message asks you to send property purchase funds through this site, treat it as fraud and contact us.

7. User Responsibilities

• Provide accurate and truthful information when submitting forms, inquiries, or account registrations.
• Use the Site only for lawful purposes and not to submit fraudulent listings or requests.
• Keep any account login credentials confidential.
• Independently verify property, legal, and financial details before making decisions.

8. Third-Party Services & Links

The Site may link to or integrate with third-party services (e.g. WhatsApp, Google Maps, payment or wallet providers). Fiona Pattaya is not responsible for the content, policies, or practices of third-party services, which are governed by their own terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fiona Consultant Group Co., Ltd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on information provided through it, including property, market, or investment-related content. Nothing in these Terms limits liability that cannot be excluded under Thai law.

10. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms or use of the Site shall be subject to the jurisdiction of the courts of Thailand.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
